Rights and Responsibilities of Test Takers

The person being evaluated has the right to:

    • To be informed of her rights and responsibilities as a participant in the evaluation.
    • To be treated with courtesy, respect, consistency, and impartiality, regardless of age, disability, ethnicity, gender, national origin, language, religion, sexual orientation, or other personal characteristics.
    • To be assessed using measures that meet professional standards and are appropriate given how the assessment results will be used.
    • To receive a brief oral or written explanation prior to the evaluation regarding its purpose(s), the type(s) of evaluation to be used, whether you will be informed of the results or whether others will be informed—or both—and the planned use(s) of the results.
    • NOTE. If the person being assessed has a disability, they have the right to request and receive information about accommodations. If the person being assessed has difficulty understanding the language of the assessment, they have the right to know, prior to the administration of the assessment, whether any accommodations will be available to them.
    • Find out in advance when the assessment will be administered, whether the results will be available and when, and whether you will have to pay any fees.
    • The assessment should be conducted, and the results interpreted, by competent individuals who adhere to professional standards and codes of ethics or to systems properly established by the relevant professional organization.
    • Request and receive information regarding whether the evaluation is optional or not, and determine the consequences of taking or not taking the evaluation or of invalidating the results; know in advance whether you will receive an explanation of the results or other feedback and when, and, if so, receive a written or oral explanation of the results within a reasonable time after the assessment and in terms that are commonly understood.
    • To understand the extent to which the client and the service provider must keep their individual responses and assessment results confidential, and how the results will be shared with those who need to receive them.
    • NOTE: When the person being evaluated is the client, they have the right to designate others (such as licensing agencies or certification bodies) to receive the evaluation results.
    • Raise concerns about the evaluation process or the evaluation results and receive information on how they will be addressed, when appropriate (for example, procedures and deadlines for filing and resolving complaints, documentation of formal complaints).
    • To be duly informed about the processing of your personal data, and to ensure that it is processed with complete confidentiality and discretion, in full compliance with applicable regulations at all times. The information provided will be used for the intended purposes, and you may exercise your rights of access, rectification, erasure, and restriction of processing at any time through the process specified for that purpose.

Responsibilities of the individuals being evaluated:

    • Read and/or listen to your rights and responsibilities as a person being evaluated.
    • Agree to comply with all requirements and instructions regarding the protection of intellectual property related to the evaluation.
    • Treat others with courtesy and respect, regardless of their age, ethnicity, gender, national origin, language, religion, sexual orientation, or other personal characteristics.
    • Ask questions before the evaluation if you are unsure why the evaluation is being conducted, how it will be conducted, what you will be asked to do, and what will be done with the results.
    • Notify an assessment administrator before the assessment of any special needs (for example, accommodations for a disability, physical condition, or medical condition that may interfere with your performance on the assessment).
    • Read or listen to the descriptive information before the assessment and pay close attention to all the instructions.
    • Notify an exam proctor if you have trouble understanding the instructions.
    • Know when and where the assessment will take place, meet all the requirements for the assessment, arrive on time with the necessary materials, and be ready for the assessment.
    • Follow the evaluation instructions provided and present yourself honestly during the evaluation (if asked for your views, attitudes, or perceptions regarding your organization, group, or another person, the person being evaluated should respond accurately).
    • Ask about and confirm acceptance of the consequences of choosing not to take or not to continue the assessment.
    • Notify the appropriate individuals if you believe that the environmental or technical conditions surrounding the administration of the assessment affected the results.
    • Ask about the confidentiality of the responses and assessment results if this is a concern for the person being assessed, and identify any relevant individuals or organizations to whom the client should send the results, if applicable.
    • Please raise any concerns you may have about the evaluation process or the results in a timely and respectful manner.
    • Be aware of the reasons for and the intended use of your personal data during the evaluation process, and agree to provide accurate, up-to-date, and correct information.
